First-hand Rental Contract

Chapter 12 of the Land Code, particularly 12:46 JB (security of tenure)

What does it mean?

A first-hand contract means the tenant has a direct contractual relationship with the property owner or the entity managing the property. This is the strongest form of rental right in Sweden and gives the tenant full security of tenure under Chapter 12 of the Land Code. With security of tenure, the tenant can essentially remain indefinitely as long as rent is paid and contract terms are followed.

First-hand contracts are typically obtained through municipal housing queues, private property owners' own queues, or through new construction. Queue times can be very long in metropolitan areas — in Stockholm often over 10 years through the Housing Agency. The contract provides the right to reasonable rent under the utility value system, the ability to apply for subletting, and the right to swap apartments with another tenant upon approval.
